All users of the Safe Haven (hereinafter referred to as ‘SH’) website are invited to read these terms of use carefully.
Agreement
By accessing this website, the user declares that he or she agrees to the following conditions, which are written in French, English, German, Spanish, Arabic and Russian. If the user does not agree to the conditions defined below or does not fully understand them, he or she is asked to refrain from accessing the site.
Data security and confidentiality
The Internet is an open network accessible to all. Data processing
The user authorizes Safe Haven to process and evaluate his data for marketing and risk management purposes and to draw up profiles in this respect. The user authorizes Safe Haven to offer him other products and services, including those of companies in its group. The user may revoke this authorization to process his data for marketing purposes or to send information at any time.
Collaboration with service providers (outsourcing)
SH may outsource services to third parties (hereinafter referred to as ‘service providers’), in particular with regard to the processing of commercial processes, IT security and systems management, market research and prospecting, the determination of credit and market risks relevant to the business, as well as the administration of contractual relationships (e.g. processing applications and contracts, collection, communication with customers). SH provides these service providers with the data necessary for the fulfilment of their contractual obligations and may, for this purpose, also transfer this data abroad. The service providers, as well as their employees and subcontractors, have a contractual obligation to ensure data protection in accordance with the requirements of the Federal Data Protection Act, to observe banking secrecy in accordance with the Federal Banking Act and to honor the duty of confidentiality. In this context, the user acknowledges that his data may be transmitted to service providers established in countries that may not have data protection equivalent to that in Switzerland. The user agrees that SH may use electronic means to communicate with him. He also agrees to the transmission of data via the internet and is aware that the internet is an open network accessible to all. Consequently, SH cannot guarantee the confidentiality of data transmitted via the internet. This means that third parties may conclude that a business relationship exists, or will exist, between themselves and SH.
Personal data and data protection
Under Article 13 of the Federal Constitution and the Data Protection Act, everyone has the right to respect for their private life and to be protected against the misuse of data concerning them. SH complies with these provisions. The user is invited to enter his or her personal data at various points on the SH website. If he or she decides to communicate personal data over the internet or by e-mail, SH will process this data in accordance with data protection legislation. By contacting SH via the internet, e-mail or any other means, the user authorizes SH to process and analyze his or her data, as well as to use it for marketing purposes and internal analyses in Switzerland and abroad.
The user has the right to revoke this authorization at any time. SH may delegate services to third parties (‘service providers’), in particular in the areas of process flow, IT security, systems management, market research and canvassing, calculation of business-related credit and market risks, as well as the management of contractual relationships (e.g. application processing and contract execution, debt collection, communication with customers). The user accepts that service providers have access to all his data processed in this context. SH may have this data processed in states that do not have data protection equivalent to that of Switzerland and may instruct service providers from such states to process this data. This data is only transmitted if these service providers have first undertaken to provide an adequate level of data protection. The user is aware that his data may be transmitted abroad and that this will also be done via the internet. He accepts this type of data transmission, as well as their processing in Switzerland and abroad. Safe Haven has the right to refuse this request without giving reasons. The user is aware that the internet is an open network accessible to all. Consequently, SH cannot guarantee the confidentiality of data transmitted via the internet. Third parties may therefore draw conclusions about an existing or imminent commercial relationship between themselves and SH. The user agrees to Safe Haven occasionally sending information about the company, its products and its services to his/her postal and email address. The user may withdraw his/her consent for the use of customer data for marketing purposes at any time in writing.
Right of access and correction of data
In accordance with the provisions of the Federal Data Protection Act of 19 June 1992, any interested party may request, by sending a written and signed request to SH, to be sent the data concerning them by post. If such data is no longer up to date, inaccurate or incomplete, the interested party may ask Safe Haven to modify the data concerning them accordingly. They may also ask Safe Haven to delete the data at any time.

Intellectual property
This entire site is the exclusive property of Safe Haven, subject to rights belonging to third parties. Safe Haven accepts no responsibility for any direct or indirect loss or damage of any kind whatsoever arising from access to the site or use of the information or advice available on this site, or from the impossibility of accessing or using the information or advice available on this site. In particular, SH, its directors, managers, employees, auxiliaries and shareholders, for any damage or loss suffered as a result of an error, technical or otherwise, a transfer failure, an overload situation, a difficulty of use, a service interruption (including in particular the system maintenance service), a delay in the transmission of information, an incompatibility between this site and the user’s files and/or software (in particular with his browser) and/or his computer, a malfunction, interference, the transmission of a computer virus or worm to his computer, illegal intrusion (for example following computer piracy), the intentional blocking of telecommunications tools and networks (for example following the mass sending of emails or denial of service attacks) or any other inadequacy of telecommunications or network service providers is excluded.
Restrictions on access
The site is not intended for people under jurisdictions in which (due to the nationality of the persons, their place of residence or for any other reason) the distribution of, access to or use of this site is prohibited. People subject to such restrictions must not access or use the site in any form whatsoever.

SH has not checked the websites linked to its own site and is not responsible for the content of these other sites. The establishment of connections to other websites is done at your own risk.
Partial nullity
If any of the provisions of these terms and conditions is invalid, non-compliant or inapplicable, this shall in no way result in the invalidity, cancellation or non-execution of the other provisions of these terms and conditions. The invalid, non-compliant or inapplicable clause shall be replaced by another valid, compliant and applicable clause corresponding as closely as possible to the meaning and purpose of the invalidated clause.
Language
Only the French version of these terms and conditions of use is legally binding.
Jurisdiction and applicable law: Any dispute related to the site or resulting from its use or access is subject to the exclusive jurisdiction of the competent courts of the canton of Geneva, subject to any recourse to the Federal Court. Swiss law applies.
